Psy Signs Pvt Ltd ("Psy Signs") operates solely as a technology-based intermediary platform that facilitates interactions between users and independent mental health professionals ("Therapists"). Psy Signs does not provide medical, psychiatric, psychological, or healthcare services and does not engage in diagnosis, treatment, prescription, or cure of any condition.

A. Terms for Patients / Users

1. Nature of Service

Users acknowledge that all therapeutic advice, guidance, or opinions are provided exclusively by Therapists based on information disclosed by the user. Psy Signs neither validates nor monitors the clinical content of consultations.

2. Eligibility

Eligibility to use the Platform is limited to individuals who are at least eighteen (18) years of age. Minors may use the Platform only with the verified consent and supervision of a parent or legal guardian.

3. Limitations of Tele-Mental Health

Users understand that tele-mental health services have inherent limitations and are not a substitute for in-person evaluation, emergency care, or crisis intervention. Psy Signs does not provide suicide prevention, emergency response, or crisis management services.

4. Payments

All payments for consultations are required to be made in advance through authorised payment gateways. Psy Signs acts solely as a facilitator of payments and shall not be responsible for refund decisions made by Therapists.

5. Accuracy of Information

Users are responsible for providing accurate, complete, and truthful information regarding their mental and physical health. Psy Signs shall not be liable for any consequences arising from inaccurate, incomplete, or misleading information provided by users.

6. Limitation of Liability

To the fullest extent permitted under applicable law, Psy Signs shall not be responsible or liable for any harm, injury, emotional distress, deterioration of mental health, self-harm, actions, decisions, or consequences arising from or related to the user's reliance on therapy sessions, advice, or personal interpretations thereof.

7. Assumption of Risk

Users acknowledge that any actions taken by them before, during, or after therapy sessions are undertaken at their own discretion and risk. Psy Signs shall not be liable for any mishap, incident, loss, damage, or adverse outcome occurring at the user's end, whether foreseeable or unforeseeable.

8. Suspension & Termination

Psy Signs reserves the right to suspend or terminate user access in cases of misuse, abuse, fraud, violation of laws, or breach of these Terms.

9. Governing Law

These Terms shall be governed by the laws of India, and any disputes shall be resolved through arbitration under the Arbitration and Conciliation Act, 1996.

Enhanced Limitation of Liability & Assumption of Risk

Users expressly acknowledge and agree that participation in mental health consultations involves personal risks, including emotional discomfort, distress, or unforeseen reactions.
Psy Signs shall not be held responsible for any harm suffered as a result of: (a) reliance on therapist advice, (b) discontinuation of therapy, (c) delay in seeking emergency care, (d) technical disruptions, or (e) personal decisions taken by users.
Users voluntarily assume full responsibility for any outcomes, consequences, or mishaps arising from their participation on the Platform.
In no event shall Psy Signs, its directors, officers, employees, or affiliates be liable for indirect, incidental, consequential, punitive, or special damages.
Total liability, if any, shall be limited to the amount paid by the user for the specific session giving rise to the claim.

B. Terms for Therapists

1. Independent Professional Status

Therapists using the Platform operate strictly as independent professionals and are not employees, agents, or representatives of Psy Signs. Nothing in these Terms shall be construed to create an employment, partnership, or agency relationship.

2. Qualifications & Licensing

Therapists warrant that they possess all required qualifications, registrations, and licenses under applicable Indian laws and professional bodies and shall maintain the same throughout their association with the Platform.

3. Platform Facilitation Fee

Psy Signs charges a platform facilitation fee equal to ten percent (10%) of the session fee plus applicable GST. Net settlements shall be processed every fifteen (15) working days.

4. Clinical Responsibility

Therapists bear sole responsibility for clinical decisions, diagnosis, treatment, record-keeping, and professional conduct. Psy Signs disclaims all liability for malpractice, negligence, or misconduct by Therapists.

5. Indemnification

Therapists agree to indemnify and hold harmless Psy Signs from any claims, losses, damages, penalties, or proceedings arising from their services, breach of law, or professional misconduct.

6. Code of Conduct

Therapists shall adhere to professional ethics, confidentiality obligations, and applicable mental health laws. Therapists shall not exploit users, engage in harassment, form inappropriate relationships, or practice beyond their qualifications. Breach of this Code may result in suspension, termination, and reporting to regulatory authorities.

7. Suspension & Termination

Psy Signs reserves the right to suspend or terminate Therapist access in the event of policy violations, unethical conduct, fraud, or legal obligations.

8. Governing Law

These Terms shall be governed by the laws of India and disputes resolved through arbitration under the Arbitration and Conciliation Act, 1996.

C. Informed Consent, Guardian Consent & Crisis Disclaimer

Informed Consent for Tele-Mental Health

By using the Platform, users confirm that they understand the nature, limitations, and risks of tele-mental health services. Users consent to participation in online consultations and acknowledge that outcomes are not guaranteed.

Guardian Consent for Minors

Parents or legal guardians consent to the minor's participation and accept responsibility for all disclosures, supervision during sessions, and outcomes arising from consultations.

Crisis & Emergency Disclaimer

Psy Signs does not provide emergency or crisis services. Users experiencing emergencies must immediately contact local emergency services (112) or the iCall helpline (9152987821). Psy Signs shall not be liable for any failure to obtain emergency assistance.

D. Grievance Redressal Mechanism

In compliance with the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, Psy Signs has appointed a Grievance Officer. All complaints shall be acknowledged within 48 hours and resolved within thirty (30) days.
